KIOSKY – TERMS & CONDITIONS (UAE VERSION)

These Terms & Conditions (“Terms”) govern your access to and use of the Kiosky service as well as
the purchase of customised phone cases and related products (“Products”) offered by BORGRETAIL
FURNITURE – L.L.C (“Kiosky”, “we”, “our”, or “us”).
By accessing the Service, placing an order, or using our kiosks or website, you agree to be bound by
these Terms.
If you do not agree, you must refrain from using our Service.

2. VAT / TAX STATUS
- BORGRETAIL FURNITURE – L.L.C is not registered for VAT and is therefore not subject to VAT under UAE law.
- All prices shown are VAT-free unless explicitly stated otherwise.
3. ELIGIBILITY
- You must be at least 18 years old, or have parental/legal guardian consent, to place an order or use the Service.
4. CUSTOM ORDERS
- Kiosky specialises in the on-demand creation of customised phone cases
- When submitting an image, design, or text (“User Content”), you confirm that:
- • You own the rights to the content, or
- • You have explicit permission to use it
- You grant Kiosky a temporary, non-exclusive licence to reproduce and process your content solely for fulfilling your order.
- Printing quality depends on the resolution of your file. Kiosky is not responsible for suboptimal results caused by low-quality uploads.
5. USER CONTENT POLICY
- You must not submit content that is:
- • Illegal or prohibited under UAE law
- • Pornographic, obscene, violent, or offensive
- • Politically sensitive, extremist, or culturally inappropriate
- • Copyrighted material you do not have the rights to use
- • Content infringing privacy, trademarks, or intellectual property
- Kiosky may reject or cancel any order containing prohibited content.
6. ORDER PROCESS & PAYMENT
- An order is considered confirmed when:
- 1. You approve the final preview on the kiosk or online
- 2. Payment is completed
- 3. Kiosky issues an order confirmation
- Payments are accepted via approved electronic payment methods.
- Since the company is not VAT-registered, no VAT will be added or charged.
7. PRICES, TAXES & IMPORT DUTIES
- All prices displayed are VAT-free.
- Customers outside the UAE may be subject to:
- • Import duties
- • Customs fees
- • Local taxes
- These charges are the customer’s responsibility.
8. DELIVERY & COLLECTION
- a) On-site orders
- Custom cases printed at the kiosk are available immediately unless otherwise stated.
- b) Delivery orders
- Delivery times are indicative and not guaranteed.
- Kiosky is not responsible for delays caused by courier services, customs, or incorrect customer information.
9. RETURNS, REFUNDS & EXCHANGES
- (Compliant with UAE Consumer Protection Law – Federal Law No. 15 of 2020
- Customised products cannot be returned, exchanged, or refunded unless:
- • The product has a manufacturing defect
- • The product arrives damaged
- • The final product does not match the preview you approved
- Defect notification:
- You must report any issue within 48 hours of receiving the product by contacting: support@kiosky.me
- Attach your order reference and photos of the defect.
- If a defect is confirmed, Kiosky may:
- • Reprint the product
- • Replace the product
- • Issue a partial or full refund (at Kiosky’s discretion)
- No refunds apply for:
- • Change of mind
- • Low-resolution user-uploaded images
- • Errors in the design approved by the customer
- • Normal wear and tear
10. ORDER CANCELLATION
- Customised orders cannot be cancelled once printing has begun
- Cancellation is only possible before production starts.
11. PRODUCT WARRANTY
- Kiosky guarantees that all products are made using appropriate materials and printing methods.
- The warranty does not cover:
- • Damage caused by the customer
- • Exposure to water, heat, chemicals, or improper handling
- • Accidental drops
- • Scratches and wear from daily use
12. INTELLECTUAL PROPERTY
- All trademarks, software, designs, kiosk interfaces, and branding remain the exclusive property of Kiosky / BORGRETAIL FURNITURE – L.L.C.
- You may not reproduce or distribute any part of our Service without written permission.
- User Content remains your property, but you grant Kiosky a licence to process it as needed to fulfil the order.
13. LIMITATION OF LIABILITY
- To the fullest extent permitted under UAE law:
- • Kiosky’s total liability is limited to the amount paid for the specific order.
- • Kiosky is not liable for consequential, indirect, or incidental damages, including device damage, data loss, emotional distress, or profit loss.
14. FORCE MAJEURE
- Kiosky shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including:
- • Natural disasters
- • Government restrictions
- • Transport disruptions
- • Power outages
- • Supply chain failures
- • Pandemics
- • Technical malfunctions
15. DATA PROTECTION
- Customer data is processed according to:
- • UAE Federal Data Protection Law (2022) and any applicable Abu Dhabi local regulations.

16. GOVERNING LAW & JURISDICTION
- These Terms are governed by the laws of the United Arab Emirates.
- Any dispute shall be resolved exclusively by the Courts of Abu Dhabi, UAE.
17. MODIFICATIONS
- Kiosky may amend these Terms at any time.
- Updated Terms take effect immediately once published on our website or displayed at the kiosk.
- Continued use of the Service constitutes acceptance of any revised Terms.
